This article aims to analyze the conditions in which the exploitation of indigenous labor occurred and the effects of the sexual division of labor. In this context, the inductive method of legal research was used, based on legislation analysis, data and bibliographic review. It was perceived the need to analyze the issue of the sexual division of labor within the scope of indigenous communities, as a result of colonialism and the impossibility of understanding multiculturalism as an impediment to the analysis of issues related to gender, but as an essential means for the analysis of the original peoples.A divisão sexual do trabalho no âmbito das comunidades indígenas foi analisada sob a ótica do período de colonização portuguesa em terras brasileiras, bem como no Serviço de Proteção ao Índio (SPI) no período de ditadura militar, ambos por meio do Relatório Figueiredo, chegando então à redemocratização e à legislação vigente. O presente artigo tem por objetivo analisar as condições em que se deu a exploração da mão de obra indígena e os efeitos da divisão sexual do trabalho. Foi utilizado, nesse âmbito, o método indutivo da pesquisa jurídica, partindo de análise de legislação, dados e revisão bibliográfica.
