| Sumario: | The sexual division of labor within the scope of indigenous communities was analyzed from the perspective of the period of Portuguese colonization in Brazilian lands, as well as the Indian Protection Service (SPI) during the military dictatorship, both through the Figueiredo Report, which then led to redemocratization and the current legislation. This article aims to analyze the conditions in which the exploitation of indigenous labor occurred and the effects of the sexual division of labor. In this context, the inductive method of legal research was used, based on legislation analysis, data and bibliographic review. It was perceived the need to analyze the issue of the sexual division of labor within the scope of indigenous communities, as a result of colonialism and the impossibility of understanding multiculturalism as an impediment to the analysis of issues related to gender, but as an essential means for the analysis of the original peoples. |
