| Resumo: | In this article two fundamental premises can be appreciated: the simple but dense and complex of the frases of Norberto Bobbio, and the double side of a same phenomenon: the law and the power, which can be considered as the Bobbian study method of border concepts in two dimensions. The author mainly focus the analysis in the legal phenomenon and makes into relation constitutionalism of rights with democratic method in order to determine the final decision on fundamental rights, hard constitutionalism or radical democracy. The author concludes recovering the democracy theory of Bobbio showing its constitutional nature. |
