Sumario:Recently, the First Chamber of the Supreme Court of Justice of the Nation issued a resolution in which it declared the admissibility of punitive damages in Mexican law, in matters of moral damage. However, applying a detailed analysis of the sentence, its arguments and grounds, leads us to the conclusion that this figure has very little in common with the “puni-tive damages” applied in the common law legal systems, and refers only to how to quantify the compensation awarded to the victim.
