This scientific article addresses the topic of socio-environmental climate justice, emphasizing the importance of including original peoples in international democratic discussions, especially in Conferences of the Parties (COP’s). The research aims to investigate, in general, how the participation of these groups can contribute to the achievement of the UN Sustainable Development Goals (SDGs), focusing particularly on SDG no. 13, which aims to adopt urgent measures against global climate change. The guiding problem of the study can be summarized in the following question: how can the inclusion of original peoples in COPs can strengthen climate justice and help Brazil achieve SDG no. 13? The embryonic hypothesis lies in the idea that this inclusion gives visibility to decolonial knowledge from the Global South, enhancing the fight against climate injustice and justifying the relevance of thematic verticalization. Thus, the article is structured in two sections, which specifically aim to analyze: the contextualization of the climate emergency and the need for global co-responsibility; the importance of the participation of indigenous peoples in climate discussions at national and international levels. Regarding methodological resources, the hypothetical-deductive scientific method was used through a qualitative approach, exploratory monographic procedures and bibliographic research techniques. Furthermore, theoretical understanding was made possible through legal interpretation with a sociological bias, recognizing Law as a dynamic social science. Finally, it is clear that a broader and more inclusive intercultural dialogue can contribute to the fulfillment of climate agendas, especially at the national level. |

A pesquisa objetiva investigar, de modo geral, como a participação desses grupos pode contribuir para o cumprimento dos Objetivos de Desenvolvimento Sustentável (ODS) da ONU, focando particularmente no ODS nº. 13, que visa a adoção de medidas urgentes contra a mudança climática global. O problema norteador do estudo pode ser sintetizado no seguinte questionamento: de que forma a inclusão dos povos originários nas COP’s pode fortalecer a justiça climática e ajudar o Brasil a alcançar o ODS nº. 13? A hipótese embrionária reside na ideia de que essa inclusão dá visibilidade aos conhecimentos decoloniais do Sul Global, potencializando a luta contra a injustiça climática e justificando a relevância da verticalização temática. Desse modo, o artigo está estruturado duas seções, as quais objetivam, especificamente, analisar: a contextualização da emergência climática e a necessidade de corresponsabilidade global; a importância da participação dos povos originários nas discussões climáticas em níveis nacional e internacional. No que concerne aos recursos metodológicos, foi empregado o método científico hipotético-dedutivo por meio da abordagem qualitativa, de procedimentos monográficos exploratórios e da técnica de pesquisa bibliográfica. Além disso, a compreensão teórica foi factibilizada através da interpretação jurídica com viés sociológico, reconhecendo o Direito como uma ciência social dinâmica.
