Resumo:The sustainability paradigm in view of Urbanistic Law and public policies for access to adequate housing brings new and important premises to the regulation of the use and settlement of urban soil for housing ends, especially in protected watercourses and reservoirs. The value of these premises allows legal operators and public administrators to realize the importance of fundamental rights to housing, to a balanced environment, and to the city, that are not conflicting and which can become a guarantee of sustainability in cities. In this paper, these premises are organized according to the following pillars: Rights the approach of legal guidelines related to the right to an ecologically balanced environment and the right to the city, and its effects on the problem of irregular and informal human settlements; Competences the designation of environmental and urbanistic competences according to the Brazilian Federal Constitution of 1988; Environmental and urban legislation the historic evolution of environmental legislation, urban legislation in relation to land tenure, and legislations for the protection of river sources; Instruments the urban and environmental instruments for promoting land tenure security and their effects in guaranteeing sustainable cities, especially when intervention instruments are employed in permanently protected areas; Case study the history of the informal settlement on permanently protected areas and especially on protected river sources, and the evolution in the treatment of settlements located in the municipality of São Bernardo do Campo; Warranties the arguing that the legislation, its guidelines and instruments are warranties of the institutional rights, and the fundamental rights approached in this paper are equipped with the necessary efficiency to be implemented
