In the second part it will analyze the specific cases of the reception of German speaking authors Rudolf von Jhering and Ernst Haeckel by Tobias Barreto and Sílvio Romero, the main intellectuals of the “Recife School” movement. This historical analysis will point out to the roots of a scientific legal perspective in Brazil, that questioned the rhetoric “bachelor” tradition and the Thomistic-scholastic influenced by religious culture.Este artigo aborda o contexto intelectual e político no qual se deu a recepção de autores de fala alemã no direito brasileiro do século XIX, destacando seus principais atores. Na primeira parte, será abordada a conjuntura histórica, focando a cultura jurídica e a importância das faculdades de direito para o panorama intelectual brasileiro em geral. Na segunda parte, serão analisados os casos específicos da recepção dos autores de língua alemã Rudolf von Jhering e Ernst Haeckel por Tobias Barreto e Sílvio Romero, os principais intelectuais do movimento da “Escola do Recife”.
