| Sumario: | This paper addresses the political and intellectual context in which the reception of German speaking authors took place in Brazilian law of the 19th, underlying its main actors. In the first part it will approach the historical conjuncture, focusing the legal culture and the importance of the law schools for the Brazilian intellectual panorama in general. In the second part it will analyze the specific cases of the reception of German speaking authors Rudolf von Jhering and Ernst Haeckel by Tobias Barreto and Sílvio Romero, the main intellectuals of the “Recife School” movement. This historical analysis will point out to the roots of a scientific legal perspective in Brazil, that questioned the rhetoric “bachelor” tradition and the Thomistic-scholastic influenced by religious culture. |
