Sumario:Currently, a hallmark of urban space has been the privatization of public spaces once. However, this process does not occur naturally. Rather, it is essential to the action of the government in building a legal framework to legitimize such a phenomenon. In this sense, the article seeks to rescue historically it was built this legal framework responsible for implementing the closed residential spaces in the city of São Carlos, in particular the Damha condominiums. To achieve the goal proposed to use federal legislation (Law 4,591 / 64 and 6,766 / 79) and municipal laws (Law 12,731 / 00 13,691 / 05) that dealt on the subject. We conclude that the municipal government of São Carlos has favored the implementation of these projects via legal framework.
