Resumo:The article shows the constitutional debate on the right to abortion between the different dominant legal schools of thought in the Supreme Court of the United States. It is argued that the debate within the Supreme Court, in addition to being a fight between liberals and conservatives, is also between two philosophies about what the political role of the Judicial Power should be within a society that considers itself a democracy: judicial activism vs. judicial restraint —the latter integrated by originalism and textualism—.
