| Sumario: | This work represents a legal comparative analysis of the crime of migrant smuggling, set forth and sanctioned in Articles 318 Bis and 411 Bis of the Spanish and Chilean criminal codes, respectively. In particular, we address the possibility to establish this figure’s protected legal interest, thus leaning to why it would be a multi-offense crime, in which both individual and collective interests are at stake. On the other hand, we address the possibility to define the victim protected by the regulation. Finally, we contemplate the criminal conduct’s ruling verb. |
