Sumario:The decree published in the GODF on December 29, 2009 modifies various regulations of the CCDF and allows, among other things, the union by means of marriage of two persons of the same gender. This fact has created great controversy among the citizens since it was released in the media. Nevertheless, the juridical analysis drawn up by institutions and jurists on the topic did not arouse great interest. These reforms are based on the right of non-discrimination inherent to every person no matter his or her sexual preference and it is concluded that homosexuals are object of discrimination as they are not entitled to union by means of marriage. This article presents convincing legal arguments in the sense that marriage, as a legal institution, only allows monogamous and heterosexual union of persons, and what is more, that those characteristics do not violate the right of non-discrimination.
