The purpose is to highlight problems and deficiencies in the regulation of workplace sexual harassment, in order to propose and support alternative solutions from effective judicial protection and fundamental rights as the central axis. The methodology to address the general objective and the specific objectives of this research consisted of an analytical and systematic study of historical, normative, doctrinal and jurisprudential sources.El presente trabajo se centra en el tránsito histórico, político y regulatorio de la figura del acoso sexual laboral en Chile, enfocando su estudio desde una perspectiva de género a partir de un análisis doctrinario y jurisprudencial. El propósito es evidenciar problemáticas y deficiencias en la regulación del acoso sexual laboral, con la finalidad de proponer y sustentar alternativas de solución desde la tutela judicial efectiva y los derechos fundamentales como eje central. La metodología utilizada para abordar el objetivo principal y los objetivos específicos de esta investigación consistió en un estudio analítico y sistemático de fuentes normativas y doctrinarias. Respecto de la jurisprudencia citada, se utilizó una muestra intencional de sentencias paradigmáticas y de relevancia, que nos parecieron más idóneas para los objetivos de esta investigación, centrándose en un análisis de contenido cualitativo de texto.Le présent travail a pour sujet l’évolution historique, politique et normative du harcèlement sexuel dans le monde du travail au Chili, évolution abordée ici à partir de la perspective de genre et en se basant sur une analyse de la doctrine et de la jurisprudence correspondantes. L’objectif est de souligner les problématiques et les manquements en matière de règles pour lutter contre le harcèlement sexuel professionnel afin de suggérer et de mettre en œuvre des alternatives qui fonctionneraient avec une protection judiciaire efficace et la garantie des droits fondamentaux comme principes de base.
