| Resumo: | The courts play an essential role in the development of alternative justice, without involving subordination and dependence on the judiciary. What is important is the relationship between these two systems the heterocompositive (due processo f law) and autocompositive (mediation and conciliation) to better fulfill its task of settling disputes arising from social interaction. In our opinion the alternative justice by its very nature must not stay away from the jurisdiction, however, not embedded in it. Therefore, our interest lies in providing a different view of the alternative justice, not only in doctrine but in order to impact better regulation of alternative justice in local law that contains it, promoting their practical effectiveness, ultimate purpose of the present investigation. |
