Resumo:The regulation of different types of electoral bodies, contributes to a more or less peaceful solution to electoral disputes and, therefore, increases (or not) the confidence of the citizens in their respective democracy and respects the maxim that the people are the holder of political power. Electoral justice constitutes a case of study to analyze, from a critical point of view, how and to what extent the practices which regulate and contribute to reinforce the representative democracy, resolve controversies in an effective and understandable manner for citizens and keep their trust in this system. The comparative methodology will show how each constitutional system regulates its electoral system and develops its respective electoral process to achieve these goals. The conclusions will determine which are the most effective electoral justice systems and guarantors of the democratic process and reforms will be proposed for the States under analysis, regarding their electoral justice system.
