Resumo:This research analyses the administrative actions, focusing on those that shows the ius punendi power of the State and impose sanctions. Also this investigative work identifies in the Ecuadorian legislation the legal resources against such actions, analyses their appeal before specialized Courts, and compare such legislation with the Colombian, Argentinian, and Common Law countries law. From that analysis emerges the existent problem regarding the treatment of punitive administrative acts, which their presumption of validity allows them to be immediately enforced. The process of appeal before the specialized Courts in such circumstances represents a questionable privilege for the administration. Considering this problem, this work develops recommendations in order to encourage a reasonable use of the punitive administrative law in Ecuador, regarding the rights and guarantees of the people that participate in the administrative process, those established in the law and in the Constitution.
