| Resumo: | Dogmatic and legal study of the construction of the criminal type of femicide in the comprehensive organic criminal code. This research has been developed around the crime of femicide as the object of study. In its introductory part, it is explained how the phenomenon of femicide constitutes the most serious expression of gender violence, and that, in all areas of the state, there is a very superficial and limited popular use of the term, which has led to it being destroy the criminal offense as described and positioned by the Comprehensive Organic Criminal Code. Femicide as a typical figure is made up of both objective and subjective elements, it has a very complex structure, but in practice we have appreciated that, with great simplicity and ease, not only in the social environment, but in jurisdictional practice, it is processed . and the generality of deaths of women is sanctioned as femicide, without necessarily presenting the elements that make up the type. The general objective pursued with the investigation was to explain, through a document of critical legal analysis, the re levance of the precise definition of the elements of the criminal type of femicide described in the Comprehensive Organic Penal Code, for the correct imputation of a fact. which is a matter of criminal prosecution; The highlight of the definition of the elements of the type of femicide was that it was managed to distance it from other criminal figures such as homicide or murder. |
