The CPC was right to strengthen and expand the presence of this agent in our legal system, as can be seen from reading article 138, enriching the debate from new perspectives of those who can effectively contribute to the excellence, completeness and precision of the final provision2. When deciding, the judge has the duty to examine and evaluate the existing evidence in the case, face all the central arguments of the controversy, appropriately interpreting and applying legal norms, in addition to observing the reasonable duration of the process. The substantial contradiction allows the subjects of the process, through this cooperative dialogue, the right to influence the formation of the judge's conviction, giving him the conditions to make a more complete and well-founded decision. In this context, the participation of the amicus curiae proves to be fundamental to encourage the procedural debate and, therefore, give rise to more complete and well-founded judicial pronouncements.Antes da entrada em vigor do Código de Processo Civil de 2015, o amicus curiae era disciplinado de forma esparsa e pontual na legislação, podendo ser citadas, dentre outras, a Lei nº 9.868/1999, que dispõe sobre a Ação Direta de Inconstitucionalidade e a Lei nº 9.882/1999, que dispõe sobre a Arguição de Descumprimento de Preceito Fundamental1. O CPC acertou ao fortalecer e ampliar a presença desse agente em nosso ordenamento jurídico, conforme se depreende da leitura do artigo 138, enriquecendo o debate a partir de novas perspectivas de quem pode efetivamente contribuir para a excelência, completude e precisão do provimento final2. Ao decidir, o juiz tem o dever de examinar e valorar as provas existentes nos autos, enfrentar todos os argumentos centrais da controvérsia, interpretando e aplicando adequadamente as normas jurídicas, além de observar a razoável duração do processo. O contraditório substancial permite aos sujeitos do processo, por meio desse diálogo cooperativo, o direito de influenciar a formação do convencimento do julgador, conferindo-lhe condições de proferir uma decisão mais completa e fundamentada.
