Resumo:This article relates to the active role of Law in Marx, taking into account the relationship between the autonomization of economic forms, discussed in Book III of Capital, and the way in which, in the daily life of capitalist society and in the field of Law, the sphere of social production appears as if it did not constitute the preponderant moment of the reproduction of bourgeois sociability. Irrational categories and empty concepts, in the daily reproduction of capital, have an inverted form of appearance. Amidst the irrational forms that are seen as normal and eternal by Political Economy, fetishism and reification appear in a stronger way; at the same time, they are effective. The legal forms appear more prominently precisely in this medium, where legal ownership of property seems to be the essential whereas it can never be. The simple legal title seems to be the one that brings about the creation of social wealth. When the practical bearers of economic relations act in a way more coupled with the irrationality of value valorization, legal transactions are more prominent in Marx.
