| Resumo: | The case study investigates the basis for the declaration of unlawfulness of the civil imprisonment of the unfaithful depositary, from the application of the balancing theory by the Supreme Court. To verify the principle resolution at the reference case, the weight attributed to the principles in conflict under the invocation of Robert Alexy’s methodology is evaluated, asking whether all technical steps were fulfilled for the overruling. In a negative response, a prudential balancing is outlined, whose objective is to illuminate pivotal aspects of the theory of fundamental rights and of the axiological hierarchy. It is concluded that, with this vector of practical rationality, the inconsistencies generated by subjectivism in judicial interpretation will be reduced. The research has an inductive and monographic methodology, a bibliographical and jurisprudential nature. |
