Descripción
Sumario:This study aims to analyze the figure of the Amparo Appeal in the context of the legal systems of Portuguese-speaking countries. It is intended to probe, in the Lusophone Circle, the presence or absence of this institute, the presence of similar legal figures, their typical characteristics, the need or not of the Amparo. The eminently descriptive and comparative approach taken here was based on some hypotheses that the reflection on the collected data would largely corroborate. Here are the axial results: the usefulness and necessity of institutes as the Amparo Appeal for the concrete, full and definitive defense of the fundamental rights of certain people, regardless of the existence in a legal system of indirect mechanisms for defending these rights. However, it is essential to streamline regulatory measures adapted to each legal system. There is not, nor should there be, a universal and ready-to-wear Amparo Appeal.
