Resumo:This paper examines the contemporary debates on freedom of contract and contractual autonomy whose main – historical and philosophical – sources are Hobbes and Kant. My aim is to analyse how these influences evolve in a context where positive and negative externalities try to restrict and modify them. So, we ask if these externalities do really transform our perspective of the freedom of contract ant contractual autonomy, particularly in Latin America.
