Resumo:The question starts from the instrumentalization of quilombola property in the national legal system. To enter into the investigation it was necessary to understand how the universalization of the direction undertakes the subalternization of black knowledge and how the Brazilian sociopolitical context intervenes in the perception of quilombola territoriality. The research is essentially qualitative, bibliographic and constructed from a methodological suit traversed by diverse knowledge, as it is, in its interior, dialogue among itself, it affects a disruptive proposal in the production of positive legal knowledge. Thus, it is concluded that territoriality, for quilombola communities, regardless of being in a rural or urban context, is related to territory, ancestry and culture.
