Methodologically, the research is based on the hypothetical-deductive method, guided by a bibliographic and documentary analysis. The theoretical basis chosen to articulate the proposed analysis is the Theory of Fraternal Law, developed by the Italian jurist Eligio Resta. Given the gender intersectionalities in operation in the context of the feminization of migration, the question arises: is it possible to analyze the (in)effectiveness of the human right to health of Brazilian migrant women in Portugal through the lens of fraternal rights? It appears that as it is a common good for humanity, health needs to be accessed by everyone and structurally articulated for everyone. Thus, fraternity is a mechanism for realizing human rights, however, it needs to become a rule and transcend the theoretical plane to be incorporated into the dynamics of health policies in Portugal in favor of realizing the human right to health of Brazilian migrant women.

O objetivo geral é analisar a (in)efetividade do direito humano à saúde das mulheres migrantes brasileiras que estão em Portugal sob a perspectiva da fraternidade. Os objetivos específicos são: 1) Abordar as complexidades interseccionais de gênero que norteiam a existência das mulheres migrantes brasileiras em Portugal; 2) Analisar a (in)efetivação do direito humano à saúde das mulheres migrantes brasileiras em Portugal sob as lentes do Direito Fraterno. A título metodológico, a pesquisa assenta-se no método hipotético-dedutivo, instruído por uma análise bibliográfica e documental. A base teórica escolhida para a articulação da análise proposta é a Teoria do Direito Fraterno, desenvolvida pelo jurista italiano Eligio Resta. Diante das interseccionalidades de gênero em operacionalização no contexto da feminização das migrações, questiona-se: é possível analisar a (in)efetivação do direito humano à saúde das mulheres migrantes brasileiras em Portugal sob as lentes do direito fraterno? Constata-se que por ser um bem comum da humanidade, a saúde precisa ser acessada por todos e ser articulada estruturalmente para todos.
