Sumario:Human rights have been a constant topic in international conventions, aiming to seek the protection of human beings in a globalized manner, wherever they are, with a view to cooperation between countries. However, with regard to women's rights, there are greater obstacles to the implementation and even normative provision, including the difficulty in visibility when addressing gender-based violence, making it necessary to point out gender particularities through the Convention on Women's Rights. Elimination of all Forms of Discrimination against Women (CEDAW) as an institution of the justice system. The Alyne versus Brazil case has great repercussions regarding the violation of the human rights of women in labor; This case has several singularities, as it was the first in which Brazil was reported to CEDAW and it is a case in which indicators of gender, race and class were decisive for the occurrence of maternal mortality. Consequently, this violation incurs the international responsibility of the Brazilian State before the CEDAW Committee, putting into question the role of international treaties and their binding force vis-à-vis the sovereignty of the signatory states-parties. Finally, the means of research technique used was bibliographical and documentary review and data collection for qualitative survey, through content analysis and, as it is a concrete case, using the case study procedure method. and inductive approach method.
