Resumo:The thesis aims to propose a new jurisprudential approach, based on the historical process of drafting and denunciation of international treaties in Brazil, as well as a critical analysis of the relevant case law, particularly from the Federal Supreme Court. The research demonstrates that the STF, in its effort to avoid a supposed weakening of the national legal order in face of international normative production, not only disregards Brazil's international relations – contrary to the principles of the Federal Constitution – but also exposes the country to potential international responsibility for the breach of ratified treaties and conventions. The approach proposed by the thesis carefully avoids requiring legislative or constitutional amendments, relying solely on a new interpretation of the national and international normative framework on the matter. As a result, it ensures respect for the constitutionally defined powers of the branches of government, compliance with Brazil’s international commitments and, most importantly, prompt access – by individuals and legal entities – to international norms upon their entry into force, thereby strengthening and protecting legal relations at both the national and international levels. The proposed analysis enables the immediate availability, to Brazilians and foreign residents in Brazil, of the rules defining fundamental rights and guarantees, which are core elements of human rights. The research adopts a qualitative, exploratory, and descriptive approach, using a legaldogmatic method with a predominantly deductive reasoning. It examines the legal regime of international treaties in Brazil, including their drafting, incorporation, and denunciation, with a focus on the constitutional interpretation provided by the STF. The study centers on STF rulings, also incorporating inductive analysis to identify and interpret argumentative patterns in the case law, thus revealing trends, disruptions, and contradictions in the Court’s jurisprudence
