Sumario:This work is focused on the analysis of third party civil liability theory, in particular that regarding the employer's responsibility for it's employees acts, and its groundings in between fault theory and risk theory, aiming to demonstrate that the contemporary Brazilian Civil Law has not disconnected itself from said theory, whereas it's contemplated amidst objective responsibility theory. For the proposed analysis, from the deductive method, after a brief historical foreshortening on the theories that guide civil responsibility and a succinct outlining of the elements that compose subjective responsibility and objective responsibility, the theme under discussion will be analyzed focusing on the main precedents of Brazilian jurisprudence to finally conclude the discussion on the relevance of the institute do Brazilian Civil Law.
