Sumario:For this study, we tried to discussthe fundamental right togender identityof transsexuals. From this perspective, the study aimsto demonstrate thatoverall, the model ofa de-mocratic state, describedin the 1988 Constitution, gender di-versityshould bean object of respectand understanding andthat the right togender identityis inherentto the personalitythe individual andalso essentialand shouldbe defended andpreserved.Appear asspecific objectivesof the analysis deve-loped, addressing the concept oftranssexuality, to discuss thecurrent movementsaround thedepathologizationof transsexua-lity, the right toexaminegender identity asinherentand fun-damentalcharacter; discuss thebills thatproceed through theBrazilian National Congress, which define the rightsof trans-sexuals. This isa descriptive,interdisciplinary, and analytical, with a theoreticalfoundation inaddressingthe issueand reviewofthe legislativepolicy proposals, as well as documents fromtransgendermovements. It was concludedthat the right tochangethe name of thetranssexual isinherent element ofhis personality andattributetheir gender identityand should notbe linked to theachievement ofsexchangesurgery.
