| Sumario: | The article consisted in analyzing the constitutionality of the Brazilian penal legislation on abortion. The historical treatment of women's sexual and reproductive rights was investigated, identifying those most susceptible to the effects of the criminalization of abortion. Through indirect data analysis, it is a qualitative research, with a bibliographic and comparative procedure method. It was possible to discuss the constitutionality of the penal type, comparing it with the positions of Constitutional Courts in other countries. Finally, we identified that the women most susceptible to the impacts of the criminalization of abortion in the country are young adults, with low income and education, black, brown and indigenous, which confirms criminal selectivity. |
