| Resumo: | In practice of law professionals, it has been a recurring basis that the open standards, principles and rules should be applied by the weighting values. However, still observed an excessively positivist stance exegetical nature, rejecting axiological aspects, which shows a practical, sometimes antagonistic, ranging from post-positivist discourse and traditional positivism. The purpose of this study integrate discussion between morality and law, the natural law, juspositivistas theories and post-positivist, for better understanding of legal theory, in the current scenario. |
