Resumo:The present thesis investigates the dysfunctions of the State’s punitive power within the Brazilian legal system, particularly in the context of the multiplicity of accountability systems and the absence of institutional coordination mechanisms among oversight bodies. Based on the premise that the jus puniendi is singular — although manifested through different legal regimes — and grounded in the concepts of Administrative Sanctioning Law, we observe that normative and institutional fragmentation fosters the duplication of sanctions and conflicting decisions. Through a systematic and rational interpretation of the legal system, we argue for the need to overcome the isolationist logic stemming from the principle of independence between jurisdictions, which contributes to legal uncertainty and disproportionality by allowing the accumulation of multiple sanctions for the same facts. We examine the dysfunctionality caused by a narrow interpretation and application of the ne bis in idem principle, analyzing it in its procedural, substantive, and transversal dimensions. Finally, as a corrective measure to this dysfunction, we propose the recognition of a new category of limitation to the punitive power: the systematic limitation, which coordinates, in light of the specific circumstances of each case, the other limits constraining the State’s punitive authority
