Descripción
Sumario:This paper aims to analyze shared custody as a preventive instrument against parental alienation, ensuring the best interests of the child and adolescent. Using a qualitative approach, the research is based on bibliographic review, doctrinal and legislative analysis, especially of Laws nº 13.058/2014 and nº 12.318/2010. It discusses the concepts of parental authority, types of custody, and the emotional and legal impacts of parental alienation. The study shows that shared custody, by promoting parental co-responsibility, significantly reduces the harmful effects of parental separation, preventing conflicts and ensuring healthy emotional bonds. It concludes that shared custody is an effective measure for the well-being and full development of the child.
